What The Employee Free Choice Act Does

Generally, The Employee Free Choice Act (EFCA) restores balance back to the way workers organize union and obtain a first contract in three ways:

  • Lets workers decide how they will determine whether they will join a union:

    • Changes the National Labor Relations Act (NLRA) to allow workers to join a union if a majority sign union authorization cards.
  • Requires, if necessary, mediation and binding arbitration on first contracts:

    Allows either the employer or the workers to go to mediation after 90 days of negotiations.

    • Allows either the employer or the workers to request binding arbitration after 30 days of mediation.

    • Arbitration determinations are binding for 2 years.
  • Increases penalties for NLRA violation

    • Authorizes fines of up to $20,000 (per violation) for willful or repeated NLRA violations during an organizing drive or first contract negotiations.

    • Triples back pay awards for workers fired or discriminated against.

    • Requires the NLRB to seek a court injunction against an employer if there is reasonable belief that the employer illegally fired, discriminated against an employee (or threatened to) or significantly interfered with employee rights during an organizing drive or first contract negotiations (This is how the law required the NLRB to seek an injunction against a union for a secondary boycott).

 

Why The Employee Free Choice Act is Important

The Employee Free Choice Act (EFCA) will level the playing field for working people like us by restoring that all-American idea of majority rule when it comes to workers joining Unions: if a majority of workers want a union they will get one under EFCA.

Our country’s laws that protect workers are broken.  They favor the corporate CEOs who’ve caused so much of the mess our country is in today. 

Even if every worker in a company wants to join a union their employer can force them to go to through a long, drawn out election process in hopes undermining union support.  CEO’s can fire workers for wanting to join a union and, just like with OSHA, they won’t be penalized until long after the damage is done.   EFCA will bring balance back to the process and help you improve your wages and benefits.

That’s why Big Business is spending millions spreading lies to defeat the Employee Free Choice Act and that’s why we need you to support the Employee Free Choice Act.

CEO’s get contracts, so should workers.  The difference is when they run a company into the ground the company gets a bailout, the CEO gets a golden parachute but workers get a pink slip.
